This Privacy Policy describes Our policies and procedures regarding the processing of Your personal data when You use the Service, informs You about Your privacy rights, and how the law protects You.

Interpretation and Definitions

Interpretation

Words with an initial capital letter have the meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of it.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
  • Application means the software program provided by the Company, downloaded by You onto any electronic device, called E.ON Myline. The Application may include a virtual assistant (Ioana My Line) based on artificial intelligence technologies, designed to provide users with support in interacting with the Service, including bill management, consumption monitoring, and making payments for electricity and natural gas services.
  • Company (referred to as "the Company," "We," "Us," or "Our" in this Privacy Policy) refers to E.ON Energie Romania SA, with its registered office in Târgu-Mureș, B-dul Pandurilor no. 42, 2nd floor, Mureș County, Romania, registered with the Trade Register under no. J2007001194266, unique registration code (CUI) 22043010, and European Unique Identifier (EUID) ROONRC J2007001194266.
  • Country refers to: Romania.
  • Device means any device that can access the Service, such as a computer, a mobile phone, or a tablet.
  • Personal Data means any information relating to an identified or identifiable natural person.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes data on behalf of the Company. This refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide it on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.
  • Third-Party Social Media Service refers to any website or social network through which a User can log in or create an account to use the Service.
  • Usage Data refers to data collected automatically, generated either by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is acting, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected
Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. This may include, but is not limited to:

  1. Email address
  2. First and last name
  3. Phone number
  4. Address, county, postal code, city

Usage Data

Usage Data is collected automatically when using the Service.

This may include information such as Your Device's IP address, browser type and version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service, including via mobile device.

Information from Third-Party Social Media Services

The Company allows You to create an account by setting a username (Username) and a password (Password). The Company also allows You to create an account and log in to use the Service through the following Third-Party Social Media Services:

  • Google
  • Facebook
  • Twitter

If You decide to register through, or otherwise grant Us access to, such a Service, We may collect Personal Data already associated with Your account — such as Your name, email address, activities, or contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your account on that Service. If You choose to provide such information during registration or otherwise, You grant the Company permission to use, share, and store it in accordance with this Privacy Policy.

Information Collected While Using the Application

While using the Application, in order to provide its features, We may collect, with Your prior consent:

  • Information Regarding Your Location

To determine location for features that require it, such as "Start Via Transilvanica Verde," the mobile app requires background location permissions (ACCESS_FINE_LOCATION, ACCESS_COARSE_LOCATION, ACCESS_BACKGROUND_LOCATION). These permissions can be disabled at any time from your phone's settings (Google instructions).

Myline uses this information exclusively to validate activities and grant the benefits provided for, in accordance with the applicable Terms and Conditions, and it is deleted after the validation process is completed or at periodic intervals.

By accepting the Terms and Conditions and by allowing the E.ON Myline application access to their location, the Customer agrees that E.ON Myline may process the location data collected through the opened application.

If the Customer (i) does not allow the application access to their location, or (ii) does not save the data in the application, the data will not be processed.

By accepting the applicable Terms and Conditions, the Customer understands and agrees that E.ON Myline will collect location data solely under the conditions and for the purposes expressly set out in the applicable documents.

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server, or it may simply be stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Information Regarding Your Interaction with Artificial Intelligence Solutions

In the course of providing the Service, You may interact with AI-based features, such as Ioana My Line.

Ioana My Line is an artificial intelligence system that, by the nature of its functionalities, is considered a system subject to the transparency obligations set out in Regulation (EU) 2024/1689. The responses provided are automatically generated based on available information and may be subject to inherent limitations of the technology used.

When using Ioana My Line, the Company may process data provided directly by the Customer during interactions such as messages and requests, as well as identification data, technical data, and information about the use of the service, necessary to provide responses, operate the system, and improve its quality. The content of conversations may also include other information that the Customer chooses to provide voluntarily.

The Customer may request the intervention of a human operator at any time, by contacting E.ON support teams at https://www.eon.ro/contact or 0265-200366.

The Company does not use Ioana My Line to make decisions based solely on automated processing that produce legal effects or that significantly affect users, within the meaning of Article 22 of Regulation (EU) 2016/679.

Use of Your Personal Data

  • The Company may use Personal Data for the following purposes:
  • To provide and maintain Our Service, including monitoring the usage of Our Service;
  • To provide the features of the Ioana My Line virtual assistant, based on artificial intelligence technologies, including generating responses, facilitating user interaction with the Service, and personalizing the user experience;
  • To manage Your Account and Your access to features related to Your status as a registered user;
  • For the performance of a contract: the development, compliance, and undertaking of the purchase contract for the products, items, or services You have purchased, or of any other contract with Us through the Service;
  • To contact You by email, phone, SMS, or push notifications regarding updates, informative communications, or security updates;
  • To provide You with news, special offers, and general information about other goods, services, and events similar to those already purchased or inquired about, unless You have opted not to receive such information;
  • To manage Your requests to Us;
  • For business transfers: We may evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding;
  • For other purposes, such as data analysis, identifying usage trends, evaluating the effectiveness of promotional campaigns, and improving Our Service, products, and Your experience.

We may share Your personal information in the following situations:

  • With Service Providers, to monitor and analyze the use of Our Service, and to contact You;
  • For business transfers (merger, sale of assets, financing, or acquisition);
  • With Our Affiliates, who will be required to honor this Privacy Policy;
  • With business partners, to offer You certain products, services, or promotions;
  • With other users, when You share information in public areas or register through a Third-Party Social Media Service — in which case Your name, profile, photos, and activity may become visible to other users or to Your contacts on that Service;
  • With Your consent, for any other purpose.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as necessary for the purposes set out in this Privacy Policy, to comply with legal obligations, resolve disputes, and enforce Our legal agreements and policies.

Usage Data is generally retained for a shorter period, except when this data is used to strengthen security, to improve the functionality of Our Service, or when We are legally obligated to retain it for a longer period.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operational offices and in any other places where the parties involved in the processing are located. This means the data may be transferred to, and maintained on, servers located outside of Romania, where data protection rules may differ.

Your agreement to this Privacy Policy, followed by Your submission of information, represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy, and no transfer of Personal Data will take place to an organization or a country without adequate safeguards for the security of such data (for example, adequacy decisions by the European Commission or standard contractual clauses, where the transfer is to a country outside the European Economic Area).

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. You will be notified before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a regulatory body such as ANRE or ANSPDCP).

Other Legal Requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation;
  • Protect and defend the rights or property of the Company;
  • Prevent or investigate possible wrongdoing in connection with the Service;

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Children's Privacy

Our Service is not intended for anyone under the age of 18, and We do not knowingly collect personal data from anyone under this age. If We identify or have reasonable grounds to believe that personal data belonging to a minor has been collected without meeting the applicable legal requirements, We will promptly take steps to delete it. Where applicable law permits the processing of a minor's data based on the consent of a parent or legal guardian, such consent will be obtained and verified by appropriate means, in accordance with Article 8 of Regulation (EU) 2016/679 (GDPR) and the provisions of Law no. 190/2018 on measures implementing the GDPR in Romania.

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party's site. We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and, before the change becomes effective, via email and/or a prominent notice within the Service. The "Last updated" date at the top of this document will be updated accordingly.
